随着科技的快速发展，人类对自然界的改造能力不断增强，自然破坏、环境污染正肆无忌惮地在全球范围内弥漫开来，成为举世瞩目的问题。我国自改革开放以来，伴随着现代化市场经济的不断发展，特别是工业化、城市化的步伐加快，人们无视对环境的保护，由环境污染和生态破坏所造成的环境破坏现象不断的暴露出来。环境侵权行为的频繁发生给人类的健康和生活都带来了极大的威胁。《2004年海洋环境质量公报》显示2003年全年12个月均有赤潮发生，长江口及浙江近岸和近海域从4月中旬到7月内发生了赤潮40次，且表现为时间长的特点，最长的一次持续35天。为了整治环境问题，法律无疑是改善生态环境的重要手段。但环境侵权行为具有：间接性、持续性、潜伏性、行为主体具有不平等性不特定性、损害后果具有广泛性等特点，所以通常会给受害人请求加害人承担环境侵权民事责任带来重重的障碍。首先，环境侵权民事责任的构成与一般侵权民事责任显然不同，其次环境侵权民事责任承担方式问题上也与一般侵权行为责任方式不同，一方面表现为在请求加害人承担损害赔偿责任时不仅在判断由谁承担赔偿责任或谁具有损害赔偿请求权问题上比一般侵权行为复杂而且还因环境侵权行为的潜伏性、持续性以及损害后果的广泛性等特征决定了在赔偿数额的问题上，必须走出按照传统侵权损害赔偿个别项目累计相加原则而无法达到救济受害人之目的的困境。另一方面，环境侵权行为的伴随性，也会导致受害人在请求停止侵权行为时，使司法机关陷入以利益衡量个基础的价值判断的困难处境。本文探讨了我国目前环境侵权民事责任体系中归责原则方面与日环境侵权法做比较，旨在学习、借鉴和吸收日本好的地方，对我国加强环境法制建设，实现可持续发展的目标，对于推动环境保护事业的健康发展具有重要的意义。
