作品标题是作品表达之主题思想的高度概括。由于其虽然内涵小，但外延大，而同时法律在这一方面的规定又比较贫瘠，导致了其在使用方面的多域性，著作权法、商标法和反不正当竞争法等各个部门法对于作品标题的保护各执其词，又相互交叉，仅就作品标题予以单独的专门保护在立法上又显得突兀。所以，本文将从著作权法、商标权法、域名权法以及反不正当竞争法四个角度,通过对国外关于作品标题的知识产权保护研究的相关法律体系进行对比，结合我国司法实践和相关理论上的观点，从分析不同标准的利弊出发，针对我国目前对作品标题知识产权的保护展开讨论。以期在知识产权层面里，对作品标题的保护建立起更加完备的法律保护体系。
