我国绝大部分农村地区而言，农村信用合作社改革的方向是恢复合作制的本来面目，因此本文以合作制为中心，结合农村信用合作社的一般理论来探索我国农村信用合作社改革中出现的问题，认为当前正在进行的农村信用社改革，在指导思想和具体做法上存在偏离合作制基本原则之处，过于注重信用社的扭亏为盈，商业化色彩过于浓重，虽然农村信用社财务上的可持续以及尽可能多的获取利润，是实现其服务社员目标的基本保障，但是片面的追求利润必然导致农村信用合作社远离农户，再加上实践中宣传动员不够，致使农户不认为农村信用社是自己的金融组织，合作制的内在产权激励和信息优势无法发挥。另外，政府干预和包办过多，本应该从事对外经营、作为独立的金融组织的信用合作社联合社成为政企合一的组织，致使信用社层级组织体系的优势无从发挥，还侵害了社员社的投资收益权和经营管理权。在此基础上提出构建我国《农村信用合作社法》的立法建议，并根据合作制的本质规定性对其立法理念、立法体系和主要制度作出设计。
